Fit AI Workout & Diet Planner ("Fit AI", "we", "our", or "us") is a mobile application developed and operated by Gamesoft Games, a company established under the laws of the European Union.

This Privacy Policy explains how we collect, use, share, and protect personal data when you use our application. As a data controller under the General Data Protection Regulation (GDPR), we are committed to processing your data lawfully, fairly, and transparently.

Data We Collect

We collect the following categories of personal data depending on how you use Fit AI:

Collected during registration (email sign-up, Google Sign-In, or Apple Sign-In) to personalise your experience.

Uploaded at your discretion for your profile. Also used when you log meals via photo — the image is processed by our AI to estimate nutritional content.

⚠️ Special Category Data

Body measurements, dietary restrictions, and health-related fitness data may constitute special category data under GDPR Article 9. We process this data only on the basis of your explicit consent, which you provide during onboarding. You may withdraw consent at any time by deleting your account.

How We Use Your Data

  • Generate personalised AI workout and meal plans tailored to your fitness and nutrition profile.
  • Track your progress over time — weight trends, workout volume, calorie intake, water consumption, and body composition changes.
  • Authenticate your account and maintain your session securely across devices.
  • Process and manage your subscription, including premium feature access and renewal notifications.
  • Serve personalised and contextual advertisements to free-tier users via Google AdMob (see Section 6).
  • Power the in-app AI chat assistant to answer fitness and nutrition questions contextualised to your profile.
  • Analyse aggregate, anonymised usage patterns to improve app features, fix bugs, and enhance performance.
  • Send transactional emails related to your account (e.g., password reset, subscription confirmation). We do not send marketing emails without your separate consent.
  • Comply with our legal obligations under applicable EU law.

Third-Party Services

Fit AI integrates the following third-party services. Each has its own privacy policy that governs their data collection:

Authentication service. Google may receive your name and email address to verify your identity. We do not receive your Google password.
Authentication service. Apple may share your name and email (or a relay address) depending on your Apple privacy settings. We receive only what Apple provides.
Advertising SDK used on the free tier. AdMob may collect your advertising ID, IP address, and usage signals to serve relevant ads. Premium subscribers do not see ads.
Anonymised usage analytics and crash reporting. Helps us identify bugs and understand how features are used. No personally identifiable fitness data is sent to Firebase.
Groq AI (LLM API)

Powers AI meal plan generation and workout plan generation. Your fitness and nutrition profile data is sent to Groq's API to generate personalised plans. Data is processed per Groq's API terms and is not used to train their models.
Apple App Store / Google Play

Subscription and in-app purchase processing. Payment details are handled entirely by Apple or Google. We only receive confirmation of subscription status — never card numbers or billing addresses.

Advertising

Fit AI is monetised through two mechanisms: subscription revenue and advertising on the free tier.

📢 Free Tier — Ad-Supported

Free users will see advertisements served by Google AdMob. These ads may be personalised based on your device's advertising identifier and usage signals. AdMob may use cookies and similar tracking technologies. You can opt out of personalised advertising at any time via your device settings (iOS: Settings → Privacy → Tracking; Android: Settings → Google → Ads).

👑 Premium Subscribers — Ad-Free

Premium subscribers (monthly or annual plan) receive a completely ad-free experience. No advertising SDKs are active for your session. Your fitness and diet data is never used for advertising targeting under any circumstances.

We do not sell your personal data to advertisers. Ad networks receive only the signals required to serve and measure ads as described in their own privacy policies.

Data Retention

  • Account data — retained for as long as your account is active. Deleted within 30 days of account deletion.
  • Workout & diet logs — retained for the lifetime of your account to power progress tracking. Deleted upon account deletion.
  • AI chat history — retained per session. You may delete chat sessions at any time within the app.
  • Voice recordings — processed in real time for meal logging transcription; not stored after processing is complete.
  • Images — profile photos and meal images retained until you delete them or delete your account.
  • Subscription records — retained for 7 years to comply with EU financial record-keeping obligations, even after account deletion.
  • Anonymised analytics — retained indefinitely as they cannot be linked back to any individual.

Children's Privacy

🚸 Age Requirement

Fit AI is intended for users aged 16 years and older. We do not knowingly collect personal data from children under 16. If you believe a child has provided us with personal data, please contact us immediately at gamesoftgames@gmail.com and we will delete the data promptly.

International Data Transfers

Some of our third-party providers (including Google and Groq) may process your data outside the European Economic Area. Where this occurs, we ensure adequate safeguards are in place, including:

  • European Commission adequacy decisions for recipient countries.
  • Standard Contractual Clauses (SCCs) approved by the European Commission.
  • The EU-U.S. Data Privacy Framework where applicable.

Security

We implement industry-standard technical and organisational security measures to protect your data, including:

  • All data transmitted between the app and our servers is encrypted using TLS 1.2 or higher.
  • Passwords are hashed using bcrypt and never stored in plain text.
  • JWT-based authentication with short-lived access tokens and secure refresh token rotation.
  • Server infrastructure protected by firewalls, intrusion detection, and regular security audits.
  • Access to personal data is restricted to authorised personnel on a need-to-know basis.

No system is completely immune to security incidents. In the event of a data breach that poses a high risk to your rights and freedoms, we will notify you and the relevant supervisory authority within 72 hours as required by GDPR Article 33.

Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we make material changes, we will notify you via an in-app notification and update the effective date at the top of this document.

Continued use of Fit AI after changes take effect constitutes your acceptance of the revised policy.

Acceptance of Terms

By downloading, installing, or using Fit AI Workout & Diet Planner, you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the application.

These Terms constitute a legally binding agreement between you and Gamesoft Games. We reserve the right to modify these Terms at any time with notice as described in Section 13.

Description of Service

Fit AI is an AI-powered fitness and nutrition application that provides:

  • AI-generated personalised workout plans based on your fitness profile.
  • AI-generated personalised meal plans based on your nutrition profile and dietary goals.
  • Workout session logging, exercise tracking, and personal record monitoring.
  • Meal and calorie logging via text, voice input, and photo analysis.
  • Water intake tracking and daily hydration goals.
  • Progress analytics including weight trends, body composition tracking, and weekly volume charts.
  • An in-app AI chat assistant for fitness and nutrition guidance.
  • Free tier access with advertisements and premium subscription access without advertisements.

Eligibility

🚸 Age Requirement

You must be at least 16 years of age to use Fit AI. By registering, you confirm that you meet this requirement. Users under 18 should obtain parental or guardian consent before using the app.

Fit AI is available globally where permitted by local law. You are responsible for compliance with local laws regarding use of fitness applications and AI-generated health content in your jurisdiction.

Account Registration

  • You may register using your email address, Google account, or Apple ID.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete information during registration and keep it up to date.
  • You may not create accounts for other persons without their consent or use another person's account.
  • You must notify us immediately at gamesoftgames@gmail.com if you suspect unauthorised access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

Subscriptions & Billing

👑 Premium Plans

Fit AI Premium is available as a monthly or annual subscription, unlocking: ad-free experience, 7-day AI meal plans, meal plan regeneration, advanced progress analytics, unlimited AI chat messages, and image meal logging.

  • Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually) through the Apple App Store or Google Play Store.
  • Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Price changes: We will notify you at least 30 days in advance of any price increase. Continued use after the effective date constitutes acceptance.
  • Cancellation: You may cancel at any time via your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time.
  • Refunds: All purchases are subject to the refund policies of Apple App Store or Google Play. We do not issue refunds directly. Contact Apple or Google for refund requests.
  • Free Trial: Where offered, free trials automatically convert to a paid subscription unless cancelled before the trial end date.
  • Downgrade: Upon cancellation or expiry, your account reverts to the free tier. Premium data (7-day plans, premium logs) remains accessible in read-only mode for 7 days before being restricted.

Free Tier & Advertising

The free tier of Fit AI is supported by advertising served through Google AdMob. By using the free tier, you acknowledge and agree that:

  • Advertisements will be displayed within the application interface.
  • Ad content is determined by Google AdMob based on contextual and interest-based signals.
  • You can opt out of personalised advertising via your device settings at any time.
  • We are not responsible for the content of third-party advertisements.
  • Upgrading to Premium removes all advertisements immediately upon subscription activation.

Acceptable Use

You agree NOT to use Fit AI to:

Attempt to reverse-engineer, decompile, or extract the source code of the application · Scrape, harvest, or systematically collect data from the app · Use the service to develop a competing product · Upload harmful, offensive, or illegal content · Attempt to circumvent subscription restrictions or access premium features without payment · Use automated scripts or bots to interact with the app · Share your account credentials with others · Interfere with or disrupt the integrity or performance of the service or its infrastructure.

AI-Generated Content Disclaimer

⚠️ Not Medical Advice

AI-generated workout plans, meal plans, and chat responses provided by Fit AI are for informational and general wellness purposes only. They do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional, registered dietitian, or certified personal trainer before beginning any new exercise or dietary programme, particularly if you have any pre-existing medical conditions.

  • AI-generated content is based on the profile information you provide. Inaccurate profile data will result in suboptimal or inappropriate recommendations.
  • We do not guarantee that AI-generated plans are suitable for your specific health circumstances.
  • You use AI-generated content entirely at your own risk.
  • Gamesoft Games assumes no liability for any injury, illness, or adverse outcome resulting from following AI-generated workout or dietary advice.

Intellectual Property

  • The Fit AI application, including its design, code, branding, AI models, and content, is the exclusive property of Gamesoft Games and is protected by EU and international intellectual property law.
  • You are granted a limited, non-exclusive, non-transferable, revocable licence to use the application for personal, non-commercial purposes.
  • Your personal data and workout/diet logs remain your property. We claim no ownership over content you input into the app.
  • By uploading images, you grant us a limited licence to process them solely for the purpose of delivering the requested feature (e.g., meal recognition).

Disclaimers

  • Fit AI is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.
  • We reserve the right to modify, suspend, or discontinue any feature of the service at any time with reasonable notice.
  • Third-party service availability (e.g., Google, Apple, Groq) is outside our control and we are not liable for their downtime.

Limitation of Liability

To the maximum extent permitted by applicable EU law:

  • Gamesoft Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Fit AI.
  • Our total aggregate liability to you shall not exceed the amount you paid for a subscription in the 12 months preceding the claim.
  • Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under EU law.

Termination

  • You may delete your account at any time within the app settings. This will terminate your access to the service and trigger data deletion as described in the Privacy Policy.
  • We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law.
  • Upon termination, your licence to use the app ends immediately. Sections covering disclaimers, limitation of liability, and governing law survive termination.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the European Union and the applicable national law of the EU member state in which Gamesoft Games is established.

In the event of a dispute, we encourage you to first contact us at gamesoftgames@gmail.com to resolve the matter informally. If unresolved, disputes may be submitted to the competent courts of the relevant EU jurisdiction. EU consumers also have the right to use the EU Online Dispute Resolution platform.
